Envita does not provide chemotherapy, radiation therapy, surgical oncology, or emergency medical services through Tele-Oncology. Participation in Tele-Oncology does not establish Envita as a patient’s primary oncology provider, and all final medical decisions remain the responsibility of the patient and their treating oncologist(s). Recommendations provided through telemedicine are based on information available at the time of consultation and are subject to the inherent limitations of remote care.

Pricing may be modified due to changes in clinical scope, vendor pricing, regulatory requirements, availability of services, or other operational considerations. Envita reserves the right to update, revise, add, or remove care-path elements, pricing structures, or payment terms with or without prior notice, except where prohibited by law or where contractual obligations expressly apply. Any quoted pricing is not guaranteed beyond the terms explicitly agreed to in writing, and future pricing, renewals, ongoing-care offerings, or additional services may be offered at different rates.
Adjunctive and Educational Nature of Information: Information provided through Envita Tele-Oncology, including educational materials, test interpretations, and supportive recommendations, is intended to supplement, not replace, discussions with a patient’s treating physician. Patients are advised to consult their oncologist or healthcare provider before making any changes to their care plan, supplements, or lifestyle.
Telehealth services are provided in accordance with applicable federal and state laws, including Arizona telehealth requirements. Clinical services are rendered only by providers who are appropriately licensed or authorized to practice in the state where the patient is physically located at the time of the telehealth encounter. The availability and scope of telehealth services may vary by state and may be subject to licensure and standard-of-care limitations.
Telehealth may not be appropriate for all conditions, and in-person evaluation or treatment may be required. Patients are responsible for disclosing their physical location at the time of each telehealth visit. In the event of a medical emergency, patients should call 911 or seek immediate in-person medical care.
Limitation of Liability: To the fullest extent permitted by applicable law, Envita, its affiliates, officers, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to participation in Tele-Oncology, integrative or adjunctive care services, telemedicine limitations, diagnostic uncertainty, third-party services, non-standard or off-label therapies, disagreements between providers, disease progression, reliance on educational or informational content, or inability to access services, even if Envita has been advised of the possibility of such damages.
Without limiting the foregoing, Envita shall not be liable for loss of profits, loss of data, loss of chance, emotional distress, personal dissatisfaction, or financial loss arising from treatment decisions made by the patient or the patient’s healthcare providers.
To the extent liability cannot be excluded under applicable law, and solely with respect to non-clinical, contractual, administrative, or service-related claims, Envita’s total cumulative liability shall be limited to the amount paid by the patient to Envita for the applicable Tele-Oncology services.
Nothing in this limitation of liability shall be construed to exclude or limit liability for professional negligence, gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
